The establishment guarantees respect for your dignity and does not discriminate in access to prevention or care. It also guarantees your right to privacy and the confidentiality of information about you.

INFORMATION ABOUT YOUR STATE OF HEALTH

Your practitioner will give you information about your state of health in a personal interview. You will be able to make decisions about your care with your practitioner, once he or she has explained everything to you. In an emergency or where it is impossible to obtain informed consent, the practitioner will, by default, contact your trusted support person or a close relative, if they are known to the establishment.

  • Your consent is essential, and you may withdraw it at any time or reverse any decision to refuse treatment.

PROTECTION OF MINORS AND PERSONS UNDER GUARDIANSHIP

Information concerning the health and care of minors and persons under guardianship is given to their legal representatives.

  • The healthcare professional must inform the persons concerned in a manner appropriate to their discernment and must involve them in the decision-making process concerning them.
  • The law of 4 March 2002 authorises doctors to dispense with obtaining the consent of holders of parental authority if the minor objects to being consulted. In such cases, the minor must be accompanied by an adult before the doctor can apply the treatment.

RULES RELATING TO THE LEGAL PROTECTION OF PROTECTED ADULTS

  • If a patient is no longer able to manage his or her own property, he or she must be represented or assisted in order to safeguard his or her interests in accordance with the law of 3 January 1968 on the protection of incapable adults.
  • In such cases, a guardianship judge may, at the request of the doctor or the family, decide on a protective measure. There are various forms of legal protection (legal protection, curatorship, guardianship) to suit every situation.

DISABLED ACCESS

The establishment is accessible to people with reduced mobility.

At the time of pre-admission, a specially adapted room will be reserved for you as well as a personalised welcome according to your request and needs.

DISCHARGE AGAINST MEDICAL ADVICE

If you wish to be discharged against medical advice, you will be asked to sign a discharge form releasing the clinic and the doctor from any liability for any consequences.

TRUSTED SUPPORT PERSON

  • In accordance with article L. 1111 - 6 of the French Public Health Code, amended by law no. 2016-87 of 2 February 2016, the clinic offers you the opportunity to appoint a trusted support person in writing, who will be consulted in the event that you are unable to express your wishes and receive the necessary information.
  • If guardianship is ordered, the guardianship judge may confirm or revoke the trusted support person's appointment.

ADVANCE DIRECTIVES

Anyone who is of full age and conscious may draw up instructions on what to do in the event that they are unable to express their wishes.

  • These directives indicate their wishes concerning the conditions for limiting or stopping treatment. They will be consulted prior to any medical decision, and their content will take precedence over any other non-medical advice.
  • These directives may be revised and revoked at any time. They have no limited period of validity. If you wish your directives to be taken into account, please make them available to the doctor who will be treating you at the hospital.

ORGAN DONATIONS

In France today, thousands of patients need a transplant to continue living or to live better. Transplants are only possible thanks to organ, tissue and cell donations. Every one of us is involved.

FOREIGN LANGUAGES

The establishment has a list of foreign language speakers. Within the limits of their competence and respect for professional secrecy, these people can help you to understand the formalities of admission or stay, information about your state of health, and requests or complaints.

KEEPING RECORDS

Medical records are kept under the responsibility of the doctor appointed by the chairman of the hospital medical conference.

Records are kept in accordance with decree 2006-6 on the hosting of personal health data, and the DHOS instruction of 14 August 2007 on keeping medical records.

INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

Our files are declared to the CNIL (law no. 78-17 of 6 January 1978, amended by the decree of 27 October 2006, relating to information technology, files and freedoms).

Certain personal information is collected during your stay. Unless you make a reasoned objection, this information will be recorded on computer for the sole purpose of managing administrative and medical data in the patient file and compiling statistics. (Order of 22 July 1996 relating to the collection and processing of medical activity data, amended by the order of 27 February 2007). Patients may exercise their right of access and rectification by contacting the doctor responsible for medical information.

ACCESS TO PATIENT RECORDS

You have the right to access information concerning your health, either directly or through a doctor you designate for this purpose. Requests must be made in writing to the General Management, accompanied by a photocopy of your identity card.

Consultation of the data available on site is free of charge. However, if you wish to obtain a photocopy or consult archived files, you will have to pay the cost of reproduction and postage.

GENERAL DATA PROTECTION REGULATION (GDPR)

Since 25 May 2018, this regulation has been applicable to all companies offering goods or services to European citizens, regardless of their nationality.

The French Data Protection Act of 6 January 1978 provides citizens with:

  • A right of access,
  • A right of rectification,
  • A right to erasure,
  • A right to object.

The RGPD adds :

  • A right to limitation of processing,
  • A right to data portability,
  • A right to withdraw consent at any time,
  • A right to lodge a complaint with the CNIL.
